Nous avons essay\u00e9 de rassembler les r\u00e9ponses aux principales questions que nous avons re\u00e7ues dans les derniers jours. \u00c9tant donn\u00e9 que la situation change d\u2019heure en heure, n\u2019h\u00e9sitez pas \u00e0 contacter le <a href=\"https:\/\/www.facebook.com\/notes\/rclalq-droit-au-logement\/rejoindre-votre-comit%C3%A9-logement-durant-les-mesures-sanitaires-du-coronavirus-cov\/2434832493285587\/\" target=\"_blank\" rel=\"noopener\">comit\u00e9 logement<\/a> le plus pr\u00e8s de chez vous pour valider les informations contenues dans ce document.<\/p>\n<p>\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>Visite d\u2019un logement<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Habituellement, la p\u00e9riode de recherche de logement est sur le point de d\u00e9buter. Si vous avez signifi\u00e9 \u00e0 votre propri\u00e9taire que vous comptiez d\u00e9m\u00e9nager \u00e0 la fin de votre bail, est-ce qu\u2019il peut vous obliger \u00e0 faire visiter votre logement m\u00eame pendant la pand\u00e9mie ? Vous craignez pour votre sant\u00e9 et votre s\u00e9curit\u00e9, que pouvez-vous faire ?<\/p>\n<p>Vous pouvez refuser la visite du logement si vous avez de bonnes raisons de craindre pour votre sant\u00e9, par exemple si vous, votre propri\u00e9taire ou l\u2019aspirant locataire avez de la toux, avez de la fi\u00e8vre, avez r\u00e9cemment c\u00f4toy\u00e9 une personne atteinte de la COVID-19 sans protection ad\u00e9quate, avez voyag\u00e9 hors du pays dans les 14 derniers jours, avez 70 ans ou plus, avez une maladie chronique ou avez un syst\u00e8me immunitaire affaibli.<\/p>\n<p>Si la visite d\u2019un logement doit avoir lieu, le locateur et l\u2019aspirant locataire devraient s\u2019assurer de respecter les mesures sanitaires recommand\u00e9es. Notamment, ceux-ci devraient conserver une distance minimale de deux m\u00e8tres entre eux et se laver les mains avant d\u2019entrer dans le logement ainsi qu\u2019\u00e0 la sortie de celui-ci. Tous devraient \u00e9viter de toucher des objets ou meubles dans le logement. Le cas \u00e9ch\u00e9ant, un seul aspirant locataire ne devrait \u00eatre pr\u00e9sent lors de la visite du logement et la dur\u00e9e de celle-ci devrait \u00eatre restreinte. Le locateur devrait \u00e9galement s\u2019assurer de d\u00e9sinfecter toutes les poign\u00e9es de porte touch\u00e9es lors de la visite.<\/p>\n<p>Vous pouvez aussi tentez de convaincre votre propri\u00e9taire de faire des visites virtuelles en proposant par exemple de prendre des photos du logement, de filmer tour vid\u00e9o ou en vous rendant disponible pour une conversation vid\u00e9o avec l\u2019aspirant locataire.<\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Travaux<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Votre propri\u00e9taire veut faire des travaux pendant la pand\u00e9mie et demande d\u2019avoir acc\u00e8s \u00e0 votre logement? Tout comme pour les visites, vous vous demandez si vous devez donner acc\u00e8s \u00e0 votre logement?<\/p>\n<p><\/p>\n<p><\/p>\n<ol class=\"wp-block-list\">\n<li>S\u2019agit-il de travaux urgents (bris d\u2019une conduite d\u2019eau, probl\u00e8me \u00e9lectrique majeur, etc.)? Si oui, demandez \u00e0 votre propri\u00e9taire que toutes les personnes (lui-m\u00eame ainsi que les travailleurs et travailleuses) respectent les mesures d\u2019hygi\u00e8ne<span style=\"font-weight: 400;\">: lavage des mains fr\u00e9quent, d\u00e9sinfectant et respect des distances entre les personnes<\/span>;<\/li>\n<li>S\u2019il ne s\u2019agit pas de travaux urgents, voyez avec lui s\u2019il n\u2019est pas possible de repousser les travaux;<\/li>\n<li>Si vous avez des raisons de craindre pour votre sant\u00e9 ou votre s\u00e9curit\u00e9, par exemple, si vous \u00eates une personne \u00e2g\u00e9e de 70 ans ou plus ou une personne atteinte d\u2019une maladie chronique ou immunosupprim\u00e9e, nous vous sugg\u00e9rons de refuser la visite.<\/li>\n<\/ol>\n<p><\/p>\n<p><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Extermination<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Une extermination (insectes, vermine et animaux nuisibles) est n\u00e9cessaire ou pr\u00e9vue dans votre logement? Vous vous demandez si vous devez donner acc\u00e8s \u00e0 votre logement? Des produits d\u2019exterminations utilis\u00e9s n\u00e9cessitent que vous quittiez le logement pendant quelques heures?<\/p>\n<p><\/p>\n<p><\/p>\n<p>Renseignez-vous aupr\u00e8s de l\u2019exterminateur sur les produits utilis\u00e9s et sur les mesures \u00e0 prendre. Si vous devez quitter le logement quelques heures en raison des produits utilis\u00e9s pour l\u2019extermination, suivez les mesures de pr\u00e9vention (lavage des mains, distance entre les personnes, etc.). Renseignez-vous aussi sur les mesures suppl\u00e9mentaires prises par l\u2019exterminateur pour \u00e9viter la propagation de la COVID-19.\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n<p>Il est malheureusement possible que votre ville ou municipalit\u00e9 n\u2019envoie plus d\u2019inspecteur visiter de logement durant la p\u00e9riode de la pand\u00e9mie. Vous pouvez tout de m\u00eame en informer la ville ou la municipalit\u00e9 et voir avec elle ce qui peut \u00eatre fait, particuli\u00e8rement si vous avez un probl\u00e8me urgent comme une infestation de rats.<\/p>\n<p><\/p>\n<p><\/p>\n<p>\u00a0<\/p>\n<p><b>D\u00e9m\u00e9nagements<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Vous devez d\u00e9m\u00e9nager et \u00e7a vous inqui\u00e8te? Vous vous demandez si vos proches peuvent vous aider sans risquer une amende pour rassemblement ill\u00e9gal?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nous vous invitons \u00e0 la prudence et \u00e0 la vigilance. Le gouvernement a \u00e9mis des<\/span><a href=\"https:\/\/www.quebec.ca\/sante\/problemes-de-sante\/a-z\/coronavirus-2019\/reponses-questions-coronavirus-covid19\/transport-deplacements-covid-19\/#c56241\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">consignes pour les d\u00e9m\u00e9nagements<\/span><\/a><span style=\"font-weight: 400;\">. Les entreprises de d\u00e9m\u00e9nagement sont consid\u00e9r\u00e9es comme un service essentiel. Vous pouvez donc y avoir recours sans probl\u00e8mes. Id\u00e9alement, demandez de l&#8217;aide des personnes qui habitent avec vous avant de demander de l&#8217;aide de l&#8217;ext\u00e9rieur. Si vous devez faire appel \u00e0 vos proches pour vous aider \u00e0 d\u00e9m\u00e9nager, assurez-vous de respecter les<\/span><a href=\"http:\/\/www.habitation.gouv.qc.ca\/fileadmin\/internet\/documents\/COVID-19-feuillet-demenagement.pdf\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">consignes sanitaires<\/span><\/a><span style=\"font-weight: 400;\"> dans la mesure du possible (2m de distance, lavage des mains fr\u00e9quent, ne pas se toucher le visage, etc.).<\/span><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Paiement du loyer<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Si vous \u00e9prouvez des difficult\u00e9s \u00e0 payer votre loyer en raison d\u2019une perte de revenu ou d\u2019emploi en lien avec la crise de la COVID-19, sachez que les gouvernements du Canada et du Qu\u00e9bec ont instaur\u00e9s plusieurs programmes d\u2019aide. <a href=\"https:\/\/www.quebec.ca\/programme-aide-gouvernementaux-covid19\/\" target=\"_blank\" rel=\"noopener\">Cet outil en ligne<\/a> est disponible pour vous aider \u00e0 d\u00e9terminer \u00e0 quel programme d\u2019aide (f\u00e9d\u00e9ral ou provincial) vous \u00eates admissible.<\/p>\n<p><a href=\"https:\/\/docs.google.com\/document\/d\/1EB0nTKNJJXesh8txqPJTt0s2clYySTAZfR8l3PWzYvI\/mobilebasic?fbclid=IwAR3CwYTPDqoMsXzYqK1VlxstX6d0BxKj8shj-ta3XjUW5LGN7bRoKyNqkNg#h.e9vki94t8mau\" target=\"_blank\" rel=\"noopener\">Ce document<\/a> cr\u00e9\u00e9 et mis \u00e0 jour fr\u00e9quemment par des avocatEs et professeurEs en droit peut r\u00e9pondre \u00e0 vos questions sur les normes d\u2019emploi \u00e0 respecter et les diff\u00e9rents programmes gouvernementaux d\u2019aide.<\/p>\n<p><\/p>\n<p><\/p>\n<p>Si vous \u00eates admissibles \u00e0 un de ces programmes, il est sugg\u00e9r\u00e9 de remplir une demande en ligne le plus rapidement possible, m\u00eame si votre employeur ne vous a pas encore fourni votre relev\u00e9 d\u2019emploi.\u00a0<a href=\"https:\/\/www.lemasse.org\/covid-19-et-assurance-chomage\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.lemasse.org\/covid-19-et-assurance-chomage\/<\/a> (pour les questions sur l\u2019assurance ch\u00f4mage)<span style=\"font-weight: 400;\">, <\/span><a href=\"http:\/\/www.lecnc.com\/membres\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">http:\/\/www.lecnc.com\/membres\/<\/span><\/a><span style=\"font-weight: 400;\"> et<\/span> <a href=\"http:\/\/macmtl.qc.ca\/groupes-et-ressources\/\" target=\"_blank\" rel=\"noopener\">http:\/\/macmtl.qc.ca\/groupes-et-ressources\/<\/a> (pour le groupe ch\u00f4mage le plus pr\u00e8s de chez vous qui pourra r\u00e9pondre \u00e0 vos questions)<\/p>\n<p>De plus, la Soci\u00e9t\u00e9 d\u2019Habitation du Qu\u00e9bec offre 2 programmes.<\/p>\n<ul>\n<li>Le <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programme\/programme\/programme_daide_financiere_aux_locataires_pour_le_paiement_de_leur_loyer_dans_le_cadre_de_la_pandem.html\" target=\"_blank\" rel=\"noopener\">Programme d\u2019aide financi\u00e8re aux locataires pour le paiement de leur loyer dans le cadre de la COVID-19<\/a> permet aux locataires de contracter un pr\u00eat sans int\u00e9r\u00eat d\u2019un montant maximal de 1 500 $ pour payer leur loyer de mai et de juin 2020. Les conditions d\u2019admissibilit\u00e9 sont cependant tr\u00e8s restrictives. <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programmes\/pret_pour_le_paiement_de_mai_ou_de_juin_2020_depliant.html\" target=\"_blank\" rel=\"noopener\">Consultez le d\u00e9pliant d\u2019information disponible en 23 langues<\/a>.<\/li>\n<li>Le <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programme\/objectif\/payer_mon_loyer\/programme\/soutien_financier_pour_les_menages_en_attente_de_leur_residence_propriete_ou_logement.html\" target=\"_blank\" rel=\"noopener\">Programme d\u2019urgence pour l\u2019h\u00e9bergement temporaire en raison de la pand\u00e9mie de la COVID-19<\/a> permet de payer l\u2019h\u00e9bergement temporaire durant un maximum de 2 mois pour les m\u00e9nages qui dont l\u2019emm\u00e9nagement dans leur r\u00e9sidence principale est report\u00e9. <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programmes\/soutien_financier_pour_les_menages_en_attente_de_leur_residence_propriete_ou_logement_depliant.html\" target=\"_blank\" rel=\"noopener\">Consultez le d\u00e9pliant d\u2019information disponible en 23 langues<\/a>.<\/li>\n<\/ul>\n<p><br \/>Vous pouvez tenter de vous entendre avec votre propri\u00e9taire. <a href=\"https:\/\/www.canada.ca\/fr\/ministere-finances\/nouvelles\/2020\/03\/plan-dintervention-economique-du-canada-pour-repondre-a-la-covid-19.html\" target=\"_blank\" rel=\"noopener\">Les grandes banques canadiennes ont confirm\u00e9 un report des paiements d\u2019hypoth\u00e8que pouvant atteindre six mois<\/a>. Votre propri\u00e9taire pourrait donc lui aussi faire preuve de souplesse. Le fait d\u2019avoir moins de revenu de loyer et d\u2019\u00eatre possiblement en d\u00e9faut de paiement de l\u2019hypoth\u00e8que ne m\u00e8nera pas \u00e0\u00a0 une saisie de l\u2019immeuble par la banque.<\/p>\n<p><\/p>\n<p><\/p>\n<p>\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>R\u00e9gie du logement : audience, ouverture de dossier, questions, etc.<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Apr\u00e8s avoir suspendu la grande majorit\u00e9 des audiences du 22 mars au 9 juin 2020, la R\u00e9gie du logement recommence \u00e0 tenir des audiences selon le <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/decret-615-2020.pdf?1591826406&amp;fbclid=IwAR1v88CzhgkZ7qfs-9CEzTYKLtc0N0bJVEH9Z4u9I57gUPR5mSRjrsyAE6s\" target=\"_blank\" rel=\"noopener\">d\u00e9cret administratif 615-2020<\/a>. De plus, ce d\u00e9cret permet \u00e0\u00a0 la R\u00e9gie du logement d\u2019imposer l\u2019utilisation de moyens technologiques lors de la tenue d\u2019une audience si les parties disposent de ces moyens et que l\u2019environnement technologique qui soutient les activit\u00e9s du tribunal le permet. V\u00e9rifiez votre dossier sur le <a href=\"https:\/\/www.rdl.gouv.qc.ca\/fr\/votre-demande-en-ligne\/etat-de-traitement-de-votre-dossier-plumitif\" target=\"_blank\" rel=\"noopener\">plumitif de la R\u00e9gie du logement<\/a> pour v\u00e9rifier quand aura lieu votre audience et si ces moyens technologiques vous sont impos\u00e9s.<\/p>\n<p><span style=\"font-weight: 400;\">Il est toujours exceptionnellement possible de <a href=\"https:\/\/www.rdl.gouv.qc.ca\/fr\/votre-demande-en-ligne\/depot-d-une-demande-au-tribunal\" target=\"_blank\" rel=\"noopener\">d\u00e9poser toutes les proc\u00e9dures en ligne<\/a><\/span>. Les personnes qui le requi\u00e8rent peuvent communiquer avec le service de renseignement t\u00e9l\u00e9phonique de la R\u00e9gie afin d&#8217;obtenir de l&#8217;assistance dans la r\u00e9daction d&#8217;une demande.<\/p>\n<p>De plus, il est maintenant possible de <a href=\"https:\/\/www.rdl2.gouv.qc.ca\/internet\/asp\/rdv\/rdv.asp\" target=\"_blank\" rel=\"noopener\">prendre rendez-vous en ligne<\/a> pour rencontrer en personne unE pr\u00e9pos\u00e9E aux renseignements dans un bureau de la R\u00e9gie du logement.<\/p>\n<p>\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>Reprises de logement, \u00e9victions et expulsions<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p>Les effets de toute d\u00e9cision de la R\u00e9gie du logement ou de tout jugement d\u2019un tribunal qui autorise la reprise d\u2019un logement ou l\u2019\u00e9viction du locataire d\u2019un logement demeurent suspendus pour le moment. Il en va de m\u00eame pour les effets de toute d\u00e9cision ou de tout jugement qui ordonne l\u2019expulsion du locataire ou de l\u2019occupant d\u2019un logement, sauf si le logement a \u00e9t\u00e9 relou\u00e9 par le locateur avant le 17 mars 2020 et que cette suspension emp\u00eacherait le nouveau locataire de prendre possession des lieux. La ministre des Affaires municipales et de l\u2019Habitation <a href=\"http:\/\/www.fil-information.gouv.qc.ca\/Pages\/Article.aspx?aiguillage=diffuseurs&amp;listeDiff=28&amp;idArticle=2805282634\" target=\"_blank\" rel=\"noopener\">a par ailleurs d\u00e9clar\u00e9 le 28 mai<\/a> dernier que la lev\u00e9e graduelle de cette mesure serait fix\u00e9e au 6 juillet 2020 pour les d\u00e9cisions rendues avant le 1er mars 2020, et au 20 juillet 2020 en ce qui concerne les d\u00e9cisions rendues \u00e0 compter du 1er mars 2020.<\/p>\n<p>Attention, le tribunal peut toujours en raison de circonstances exceptionnelles ordonner l\u2019ex\u00e9cution d\u2019une de ses d\u00e9cisions ou d\u2019un de ses jugements malgr\u00e9 cette suspension.<\/p>\n<p>\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>Sous-location\u00a0<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p>Des situations de sous-locataires de logements dont les locataires reviennent plus t\u00f4t que pr\u00e9vu de s\u00e9jours prolong\u00e9s \u00e0 l\u2019\u00e9tranger ou des locataires ayant sous-lou\u00e9 leur logement pour une p\u00e9riode et souhaitant revenir vivre dans leur logement pourraient se pr\u00e9senter.<\/p>\n<p><\/p>\n<p><\/p>\n<p>L\u2019entente de sous-location prend fin au plus tard \u00e0 la date \u00e0 laquelle prend fin le bail du logement. Le ou la sous-locataire n\u2019a cependant pas \u00e0 quitter les lieux avant d\u2019avoir re\u00e7u un avis de 10 jours \u00e0 cette fin.<\/p>\n<p>Si l\u2019entente de sous-location ne pr\u00e9voit pas \u00a0de date de fin, le ou la\u00a0 locataire peut reprendre le logement dont il est signataire du bail, avec un avis de 10 jours et ce m\u00eame si\u00a0 l\u2019entente de sous-location pr\u00e9voit une date ult\u00e9rieure (<a href=\"http:\/\/legisquebec.gouv.qc.ca\/fr\/showdoc\/cs\/ccq-1991#se:1940\" target=\"_blank\" rel=\"noopener\">C.c.Q. art. 1940 al. 2<\/a>, Code civil du Qu\u00e9bec).<\/p>\n<p><\/p>\n<p><\/p>\n<p>Cependant, si unE sous-locataire refuse de quitter, il faut une ordonnance de la R\u00e9gie pour l\u2019obliger \u00e0 quitter. If you have informed your landlord that you will be moving out at the end of your lease, can the landlord force you to accept visits to your apartment during the pandemic? Do you fear for your health and your security, what can you do?<\/p>\n<p>You can refuse the visit if you have good reasons to fear for your health, for example if you, your landlord or the prospective lessee have a couch, a fever, have been with someone infected with COVID-19 without proper protection, have traveled outside the country in the last 14 days, are 70 years old or older, have a chronic disease or have a weak immune system.<\/p>\n<p>If a dwelling is to be visited, the lessor and the prospective lessee should ensure that the recommended health measures are respected. In particular, they should remain a minimum distance of two metres apart, and wash their hands before entering and on leaving the dwelling. Everyone should avoid touching objects or furniture in the dwelling. Where possible, a single prospective lessee should visit the dwelling and the duration of the visit should be limited. The lessor should also ensure that all door handles touched during the visit are disinfected.<\/p>\n<p>You can also try to convince your landlord to do virtual visits by suggesting to take pictures of the dwelling, to film a tour of the dwelling or to accept to do a video chat with the prospective lessee.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Maintenance work<\/strong><\/p>\n<p>Your landlord would like to do some work on the apartment during the pandemic and requests access to your apartment? Just as with the visits, you wonder if you should give them access?<\/p>\n<ol>\n<li>Is the work required urgent (burst water pipe, major electrical problems, etc.)? If the answer is yes, ask your landlord that all people (landlord &amp; professionals) having access to the apartment should respect hygiene measures (hand washing, liquid disinfectant, and minimal distance);<\/li>\n<li>If it\u2019s not urgent work, discuss with your landlord the possibility of postponing the visit.<\/li>\n<li>Should you have reasons to fear for your health or security, for example, if you are over 70 years old, or a person with a chronic disease or immunosuppressed, we suggest you refuse the visit.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>Extermination<\/strong><\/p>\n<p>An extermination (insects, vermine &amp; harmful animals) is necessary or previously scheduled in your apartment? You wonder if you should give them access? Extermination products used require that you vacate the apartment for a couple hours, what do you do?<\/p>\n<p>Ask the exterminator about the products used and the measures required. If you have to leave the apartment for a couple of hours, please follow the preventive hygiene measure (washing your hands, maintaining required distance, etc.)<\/p>\n<p>Inquire as well about any additional measures taken by the exterminator in order to prevent the spread of COVID-19.\u00a0<\/p>\n<p>It is unfortunately possible that the city or municipality won\u2019t send any inspectors to visit apartments during the pandemic. However, if you have any major problems such as rat infestation, you can contact and inform the city or municipality.<\/p>\n<p>\u00a0<\/p>\n<p><b>Moving<\/b><\/p>\n<p><span style=\"font-weight: 400;\">You have to move and are worried? You wonder if you can ask relatives or friends to help you move without facing fines for illegal gathering?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Stay vigilant and prudent. However, the conditions are very strict. <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programmes\/pret_pour_le_paiement_de_mai_ou_de_juin_2020_depliant.html\" target=\"_blank\" rel=\"noopener\">See this leaflet available in 23 languages for more information<\/a>.<\/li>\n<li><a href=\"http:\/\/www.habitation.gouv.qc.ca\/english\/detail_du_programme_english\/programme\/financial_support_for_households_awaiting_their_residence_property_or_dwelling.html\" target=\"_blank\" rel=\"noopener\">The Financial support program for households awaiting their residence<\/a> allows households whose plans to move into their main residence have been delayed because of the COVID-19 pandemic to receive up to $2,000 per month for a maximum of two months to cover the costs of temporary accommodation. <a href=\"http:\/\/www.habitation.gouv.qc.ca\/programmes\/soutien_financier_pour_les_menages_en_attente_de_leur_residence_propriete_ou_logement_depliant.html\" target=\"_blank\" rel=\"noopener\">See this leaflet available in 23 languages for more information<\/a>.<\/li>\n<\/ul>\n<p><br \/>You can also reach an agreement with your landlord. <a href=\"https:\/\/www.canada.ca\/en\/department-finance\/news\/2020\/03\/canadas-covid-19-economic-response-plan-support-for-canadians-and-businesses.html#Mortgage_Default_Management\" target=\"_blank\" rel=\"noopener\">Canada\u2019s large banks have confirmed that this support will include up to a 6-month payment deferral for mortgages.<\/a><\/p>\n<p>Your landlord will also show flexibility under these circumstances. \u00a0<\/p>\n<p>The fact that there is less rental income and maybe default of paying the mortgage will not result in seizure of the building by the bank.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Rental board\u00a0: hearings, filing an application, questions, etc. <\/strong><\/p>\n<p>After having suspended almost all hearings from March 22nd to June 9th 2020, the R\u00e9gie du logement is holding hearings again following the <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/decret-615-2020.pdf?1591826406&amp;fbclid=IwAR1v88CzhgkZ7qfs-9CEzTYKLtc0N0bJVEH9Z4u9I57gUPR5mSRjrsyAE6s\" target=\"_blank\" rel=\"noopener\">ministerial order 615-2020<\/a>. Moreover, this order allows the R\u00e9gie du logement to impose the use of technological means when holding a hearing if the parties have those means and the technological environment supporting the Tribunal&#8217;s activities permits it. You can see the <a href=\"https:\/\/www.rdl.gouv.qc.ca\/en\/your-application-online\/processing-status-of-your-case\" target=\"_blank\" rel=\"noopener\">processing status of your case<\/a> to check when your hearing is going to be hold and if technological means are imposed.<\/p>\n<p>It is still possible to <a href=\"https:\/\/www.rdl.gouv.qc.ca\/en\/your-application-online\/filing-an-application-to-the-tribunal\" target=\"_blank\" rel=\"noopener\">file all applications online<\/a>. Should you require more information you can contact the R\u00e9gie du lodgement.<\/p>\n<p>Moreover, it is now possible to <a href=\"https:\/\/www.rdl2.gouv.qc.ca\/internet\/asp\/rdv\/rdv.asp\" target=\"_blank\" rel=\"noopener\">make an appointment online<\/a> to meet in person with an information clerk at one of the offices of the R\u00e9gie du logement.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Suspension of the effects of certain judgments: Repossession of a dwelling | Eviction<\/strong><\/p>\n<p>The effects of all decisions by the R\u00e9gie du logement and all judgments by a tribunal authorizing the repossession of a dwelling or ordering the eviction of the lessee or the occupant of a dwelling remain suspended for the time being, unless the lessor rented the dwelling again before March 17, 2020, and the suspension would prevent the new lessee from taking possession of the premises. Additionally, the Minister of Municipal Affairs and Housing <a href=\"http:\/\/www.fil-information.gouv.qc.ca\/Pages\/Article.aspx?aiguillage=diffuseurs&amp;listeDiff=28&amp;idArticle=2805282634\" target=\"_blank\" rel=\"noopener\">stated on May 28<\/a> last that the gradual lifting of that measure would begin on July 6, 2020 for decisions rendered before March 1, 2020, and on July 20, 2020 for decisions rendered on or after March 1, 2020.<\/p>\n<p>Caution, the tribunal may still under exceptional circumstances, order the execution of one of its decisions or judgments despite the suspension.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Sub-leting<\/strong><\/p>\n<p>Sub-tenants may find themselves in situations where the tenants have returned earlier from their trips, or tenants wish to return to live int their apartment earlier than expected.<\/p>\n<p>The sub-leting agreement terminates not later than the date on which the lease of the dwelling terminates. However, the sublessee is not bound to vacate the premises before receiving 10 days\u2019 notice to that effect.<\/p>\n<p>If the sub-leting agreement doesn\u2019t specify an end date, the tenant may repossess the dwelling which his or her name figures on the lease, with a 10 days\u2019 notice, even if the sub-letting agreement indicates another date. (<u><a href=\"http:\/\/legisquebec.gouv.qc.ca\/fr\/showdoc\/cs\/ccq-1991#se:1940\" target=\"_blank\" rel=\"noopener\">C.c.Q. art. 1940 al. 2<\/a><\/u>, Code civil du Qu\u00e9bec).<\/p>\n<p>However, if the sub-tenant refuses to leave, a judgement from the rental board is required to make them leave. (The decision of the rental board to hold hearings on this topic has not been made clear yet, under the circumstances.)<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00a0Cleaning point of entry and common areas<\/strong><\/p>\n<p>Many tenants, particularly those living in large housing units with numerous apartments, elevators, common areas and main entryway, that sees a lot of traffic, may wonder about the responsibility of the landlord to adopt stronger hygienic measures during the COVID-19 crisis.<\/p>\n<p>The <a href=\"https:\/\/santemontreal.qc.ca\/en\/public\/coronavirus-covid-19\/?fbclid=IwAR1POPqHY6e3Mr7qREycUrcE0owY85awkeEoYVxHCtek4-LD8tE56b4Nt7g\" target=\"_blank\" rel=\"noopener\">Direction r\u00e9gionale de sant\u00e9 publique<\/a> announced that owners of residential buildings must put in place the following <a href=\"https:\/\/santemontreal.qc.ca\/fileadmin\/fichiers\/Campagnes\/coronavirus\/Consignes-directives\/Affiche-ProprietaireResidentsImmeublesLogementsMultiples-EN.pdf\" target=\"_blank\" rel=\"noopener\">measures<\/a> to stop the spread of the virus:<\/p>\n<p>1.Clean and disinfect every day, and every 2 to 4 hours if possible, shared spaces (e.g. lobby, hallways) :<\/p>\n<ul>\n<li>doorknobs<\/li>\n<li>elevator buttons<\/li>\n<li>all other surfaces in common areas.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>2.No visitors<\/p>\n<ul>\n<li>Exception: emergency repairs or humanitarian reasons (essential care, end-of-life situations, visits to a new mom, etc.) NOTE: No exceptions for people who have returned from travelling abroad less than 14 days ago or who have symptoms of COVID-19.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>3.No gatherings<\/p>\n<ul>\n<li>No visits to other apartments.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>4.Delivery of food or other items only to the lobby<\/p>\n<ul>\n<li>No delivery person should walk around in hallways.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>Certain landlord associations also recommend to their members to clean more frequently the entryways and high traffic areas of the building.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Non-renewal of lease and moving<\/strong><\/p>\n<p>You are wondering how long will these confinement measures last? You haven\u2019t renewed your lease, you haven\u2019t found a new apartment before the end of your lease, and you can\u2019t look for an apartment due to the confinement measures?<\/p>\n<p>It is too early right now to evaluate how long this pandemic will last.
