Le Regroupement des comit\u00e9s logements et \nassociations de locataires du Qu\u00e9bec (RCLALQ) rappelle aux locataires \nqu&#8217;il s&#8217;agit d&#8217;une pratique ill\u00e9gale et qu&#8217;ils sont en droit de \nr\u00e9cup\u00e9rer les sommes vers\u00e9es.<\/h4>\n\n\n\n<p>Selon l&#8217;article 1904 du Code civil du Qu\u00e9bec, un propri\u00e9taire ne peut\n pas exiger une somme d&#8217;argent autre que le loyer. Bien que la loi soit \nclaire, le RCLALQ constate qu&#8217;elle est peu respect\u00e9e par les \npropri\u00e9taires. \u00abChaque ann\u00e9e, des milliers de locataires sont flou\u00e9s par\n des propri\u00e9taires qui leur r\u00e9clament un d\u00e9p\u00f4t d&#8217;argent, \u00e0 titre \nd&#8217;exemple, pour obtenir les cl\u00e9s\u00bb confirme Catherine Tragn\u00e9e, \nporte-parole du RCLALQ.<\/p>\n\n\n\n<p>Le m\u00eame article du Code civil du Qu\u00e9bec indique \u00e9galement qu&#8217;un \npropri\u00e9taire ne peut exiger d&#8217;avance que le paiement du premier terme de\n loyer. Ainsi, r\u00e9clamer lors de la signature du bail le paiement du \ndernier mois de loyer ou encore le paiement de quelques mois de loyer \u00e0 \nl&#8217;avance est interdit. \u00abIl s&#8217;agit d&#8217;une entrave majeure \u00e0 l&#8217;acc\u00e8s au \nlogement, particuli\u00e8rement pour les m\u00e9nages pauvres qui n&#8217;ont pas les \nmoyens de verser les sommes demand\u00e9es par les propri\u00e9taires d\u00e9linquants\u00bb\n d\u00e9plore madame Tragn\u00e9e.&nbsp;<\/p>\n\n\n\n<p>Dans le m\u00eame ordre d&#8217;id\u00e9e, le RCLALQ s&#8217;indigne des demandes \nincessantes formul\u00e9es par les lobbies de propri\u00e9taires en faveur de \nl&#8217;instauration d&#8217;un d\u00e9p\u00f4t de garantie, une caution qui serait conserv\u00e9e \npar le propri\u00e9taire s&#8217;il juge que le logement n&#8217;a pas \u00e9t\u00e9 laiss\u00e9 dans un\n \u00e9tat convenable au d\u00e9part du locataire. En plus d&#8217;amener une charge \nfinanci\u00e8re suppl\u00e9mentaire pour les m\u00e9nages locataires, une telle \ncaution, si elle \u00e9tait permise, serait la source de bien des abus de la \npart de propri\u00e9taires. \u00abLa moindre usure normale du logement serait \nconsid\u00e9r\u00e9e par les propri\u00e9taires immobiliers comme un motif pour garder \nle d\u00e9p\u00f4t.
