{"id":3126,"date":"2013-01-25T09:00:00","date_gmt":"2013-01-25T14:00:00","guid":{"rendered":"https:\/\/rclalq.qc.ca\/?p=3126"},"modified":"2020-07-06T16:56:59","modified_gmt":"2020-07-06T20:56:59","slug":"des-loyers-hors-de-controle","status":"publish","type":"post","link":"https:\/\/rclalq.qc.ca\/en\/2013\/01\/des-loyers-hors-de-controle\/","title":{"rendered":"Des loyers hors de contr\u00f4le"},"content":{"rendered":"\n<p>MONTREAL, le 25 \njanvier 2013 &#8211; Le Regroupement des comit\u00e9s logement et associations de \nlocataires du Qu\u00e9bec (RCLALQ) recommande aux locataires d&#8217;examiner \nattentivement toute hausse de loyer sup\u00e9rieure aux indices publi\u00e9s \naujourd&#8217;hui par la R\u00e9gie du logement, et les incite \u00e0 refuser toute \naugmentation jug\u00e9e abusive apr\u00e8s \u00e9valuation. \u00ab&nbsp;Pour freiner les hausses \nde loyer, les locataires doivent absolument refuser les augmentations \nabusives de loyer. C&#8217;est un droit!&nbsp;\u00bb plaide Maude B\u00e9gin Gaudette, \nporte-parole du RCLALQ. <\/p>\n\n\n\n<p>Le\n RCLALQ rappelle que les locataires ont le droit de refuser une hausse \nabusive de loyer et peuvent demeurer dans leur logement. Beaucoup de \nlocataires croient qu&#8217;un refus entra\u00eene n\u00e9cessairement un d\u00e9m\u00e9nagement. \nOr, c&#8217;est faux. Les locataires ont un mois \u00e0 compter de la r\u00e9ception de \nl&#8217;avis pour refuser la hausse ou toute modification propos\u00e9e au bail. Le\n RCLALQ constate que les locataires exercent peu ce droit, et ce, par \ncrainte de repr\u00e9sailles. \u00ab&nbsp;C&#8217;est dommage parce que nous estimons que \npr\u00e8s de neuf locataires sur dix re\u00e7oivent une augmentation abusive de \nloyer\u00bb soutient madame B\u00e9gin Gaudette. <\/p>\n\n\n\n<p><strong>Hausse abusive&nbsp;: comment \u00e9valuer&nbsp;?<\/strong><\/p>\n\n\n\n<p>Afin de d\u00e9terminer le caract\u00e8re abusif d&#8217;une hausse de loyer, il faut disposer de certaines informations.Outre\n le taux d&#8217;ajustement de la R\u00e9gie (pour un logement non chauff\u00e9 0.9%, \npour un logement chauff\u00e9 \u00e0 l&#8217;\u00e9lectricit\u00e9 0.9%, au gaz 0.2% ou au mazout \n1.7%), les locataires doivent conna\u00eetre la variation des taxes fonci\u00e8res\n et le montant des travaux majeurs effectu\u00e9s dans le logement et\/ou \nl&#8217;immeuble. Il est vrai qu&#8217;il peut \u00eatre difficile pour des locataires de\n statuer sur une augmentation de loyer. Le RCLALQ invite les locataires \u00e0\n communiquer avec leur groupe logement afin d&#8217;\u00eatre soutenus dans leurs \nd\u00e9marches (les coordonn\u00e9es des groupes logement sont disponibles en \nligne au <a href=\"http:\/\/test.rclalq.qc.ca\/\">www.rclalq.qc.ca<\/a>) <\/p>\n\n\n\n<p><strong>La R\u00e9gie du logement pr\u00f4ne la n\u00e9gociation au d\u00e9pend de l&#8217;application des r\u00e8glements.&nbsp;<\/strong><\/p>\n\n\n\n<p>Le\n RCLALQ d\u00e9nonce le manque de leadership de la R\u00e9gie en mati\u00e8re de droit \nau logement et de contr\u00f4le des loyers. D&#8217;embl\u00e9e, la R\u00e9gie pr\u00e9conise la \nn\u00e9gociation alors que les variations moyennes qu&#8217;elle publie sont \nvalables. \u00ab&nbsp;Pourquoi une telle approche si, en fixation, c&#8217;est le \nr\u00e9sultat de la grille de calcul de la R\u00e9gie qui d\u00e9termine \nl&#8217;augmentation?\u00bb a soutenu madame B\u00e9gin Gaudette. \u00ab&nbsp;Puisque la R\u00e9gie \nconna\u00eet tr\u00e8s bien le rapport de force entre locataires et propri\u00e9taires,\n son plaidoyer pour la n\u00e9gociation est d&#8217;autant plus d\u00e9connect\u00e9 de la \nr\u00e9alit\u00e9.&nbsp;\u00bb a-t-elle continu\u00e9. Selon le RCLALQ, il faut un contr\u00f4le \nobligatoire et universel des loyers afin de prot\u00e9ger ad\u00e9quatement les \nlocataires.
