{"id":3347,"date":"2017-03-16T10:00:58","date_gmt":"2017-03-16T14:00:58","guid":{"rendered":"https:\/\/rclalq.qc.ca\/?p=3347"},"modified":"2020-07-21T14:57:11","modified_gmt":"2020-07-21T18:57:11","slug":"lhypocrisie-des-proprietaires-immobiliers","status":"publish","type":"post","link":"https:\/\/rclalq.qc.ca\/en\/2017\/03\/lhypocrisie-des-proprietaires-immobiliers\/","title":{"rendered":"L\u2019hypocrisie des propri\u00e9taires immobiliers"},"content":{"rendered":"\n<p>Dans un <a href=\"http:\/\/plus.lapresse.ca\/screens\/6bb7e368-e680-447e-ac3a-5bdb30e20d51%7C_0.html\" target=\"_blank\" rel=\"noreferrer noopener\">r\u00e9cent article publi\u00e9 dans La Presse+<\/a>,\n Pierre-Yves McSween laisse entendre que les principaux responsables de \nl\u2019\u00e9tat lamentable du parc de logements locatifs du Qu\u00e9bec seraient \ncertaines institutions, dont la R\u00e9gie du logement, qui alourdiraient le \nfardeau des r\u00e9novations pour les propri\u00e9taires et les emp\u00eacheraient de \nrentabiliser leurs investissements.<\/p>\n\n\n\n<p>Dans son texte, pas un seul mot sur les obligations l\u00e9gales des \npropri\u00e9taires ni sur la logique malsaine qui fait du logement un simple \nsecteur d\u2019investissement devant \u00eatre rentabilis\u00e9 au maximum, et ce, au \nd\u00e9triment des locataires.<\/p>\n\n\n\n<p><strong>Un logement en bon \u00e9tat&nbsp;: une obligation du propri\u00e9taire<\/strong><\/p>\n\n\n\n<p>En vertu du Code civil du Qu\u00e9bec, les propri\u00e9taires immobiliers ont \ndes obligations quant \u00e0 l\u2019\u00e9tat des logements&nbsp;: faire les r\u00e9parations \nn\u00e9cessaires, maintenir le logement en bon \u00e9tat d\u2019habitabilit\u00e9, respecter\n les exigences minimales relativement \u00e0 l\u2019entretien, \u00e0 la s\u00e9curit\u00e9 et \u00e0 \nla salubrit\u00e9 d\u2019un immeuble. Aucune consid\u00e9ration \u00e9conomique ou \nr\u00e9glementaire ne devrait justifier ces manquements. Est-il n\u00e9cessaire de\n rappeler qu\u2019un logement insalubre met en danger la sant\u00e9 des locataires\n ?<\/p>\n\n\n\n<p><strong>La R\u00e9gie du logement n\u2019emp\u00eache pas les hausses abusives de loyer<\/strong><\/p>\n\n\n\n<p>Ensuite, concernant les r\u00e8gles de la R\u00e9gie du logement li\u00e9es aux \nd\u00e9penses de travaux majeurs, il est surprenant de voir monsieur McSween \nreprendre mot \u00e0 mot les arguments des lobbies de propri\u00e9taires \nimmobiliers en affirmant qu\u2019il faudra plus de 40 ans pour qu\u2019un \npropri\u00e9taire puisse avoir un retour sur son investissement.<\/p>\n\n\n\n<p>La base de ce raisonnement est erron\u00e9e. Le taux d\u2019ajustement pr\u00e9vu \npar la R\u00e9gie du logement dans le cas de d\u00e9penses d\u2019immobilisation n\u2019a \nstrictement rien \u00e0 voir avec un amortissement de cette d\u00e9pense sur un \nnombre d\u2019ann\u00e9es. Ce taux est plut\u00f4t fix\u00e9 en fonction de la moyenne des \ntaux d\u2019int\u00e9r\u00eat sur les certificats de placements garantis, moyenne qui \nest major\u00e9e de 1&nbsp;% dans le but d\u2019inciter les propri\u00e9taires \u00e0 investir \nsur leur immeuble. Ainsi, si cette ann\u00e9e la R\u00e9gie permet aux \npropri\u00e9taires qui ont fait des travaux majeurs de r\u00e9cup\u00e9rer en \naugmentation de loyer 2,4&nbsp;% des sommes investies, c\u2019est parce que la \nmoyenne des taux d\u2019int\u00e9r\u00eat est de 1,4&nbsp;%.<\/p>\n\n\n\n<p>Si on recule de quelques ann\u00e9es, \u00e0 une \u00e9poque o\u00f9 les taux d\u2019int\u00e9r\u00eat \n\u00e9taient plus \u00e9lev\u00e9s, ce taux de r\u00e9cup\u00e9ration atteignait r\u00e9guli\u00e8rement \nles 10&nbsp;%. \u00c0 cette \u00e9poque, nous n\u2019entendions jamais les propri\u00e9taires se \nplaindre que leur investissement serait enti\u00e8rement r\u00e9cup\u00e9r\u00e9 en \nseulement dix ans! Et \u00e9videmment, \u00e0 l\u2019\u00e9ch\u00e9ance de ces dix ann\u00e9es, le \nloyer des locataires concern\u00e9s n\u2019\u00e9tait pas diminu\u00e9. La hausse calcul\u00e9e \npar la R\u00e9gie du logement relativement \u00e0 une d\u00e9pense de travaux ou \nd\u2019am\u00e9liorations majeures fait partie int\u00e9grante du loyer.<\/p>\n\n\n\n<p>En fin de compte, il s\u2019agit d\u2019un faux d\u00e9bat puisque la R\u00e9gie du \nlogement n\u2019emp\u00eache en rien la flamb\u00e9e des loyers. Annuellement, le \ntribunal fixe moins de 0,5&nbsp;% des loyers du Qu\u00e9bec. Ainsi, l\u2019\u00e9crasante \nmajorit\u00e9 des loyers \u00e9chappe au contr\u00f4le de la R\u00e9gie du logement. \nConcr\u00e8tement, les propri\u00e9taires ne se soucient gu\u00e8re des r\u00e8gles. Ils \ntirent plut\u00f4t profit d\u2019un rapport de force qui est tout \u00e0 leur avantage \npour hausser abusivement les loyers.<\/p>\n\n\n\n<p>Quoique puissent laisser entendre monsieur McSween et les lobbies de \npropri\u00e9taires, l\u2019immobilier demeure un secteur lucratif. Selon la \nF\u00e9d\u00e9ration des chambres immobili\u00e8res du Qu\u00e9bec, entre 2003 et 2013, le \nprix moyen de vente d\u2019un triplex a augment\u00e9 de 99&nbsp;% \u00e0 Montr\u00e9al et de \n172&nbsp;% \u00e0 Qu\u00e9bec. Aussi, selon les chiffres de la SCHL, depuis le d\u00e9but \ndes ann\u00e9es 2000, les revenus de loyer augmentent en moyenne de 3&nbsp;% \nannuellement. Si on ajoute \u00e0 cela les nombreux avantages fiscaux dont \ndisposent les propri\u00e9taires immobiliers, il est fort questionnable de \nvouloir faire passer les propri\u00e9taires n\u00e9gligents comme de pauvres \nvictimes du syst\u00e8me.<\/p>\n\n\n\n<p><strong>Que faire contre l\u2019insalubrit\u00e9?&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/strong><\/p>\n\n\n\n<p>Appelons un chat, un chat&nbsp;: un propri\u00e9taire immobilier qui loue un \nlogement insalubre est un propri\u00e9taire d\u00e9linquant. Il faut le \ncontraindre \u00e0 respecter ses obligations. Actuellement, autant la R\u00e9gie \ndu logement que les autorit\u00e9s municipales et provinciales \u00e9chouent \u00e0 \nprot\u00e9ger convenablement les locataires face \u00e0 l\u2019insalubrit\u00e9.
