{"id":4664,"date":"2022-01-19T15:14:45","date_gmt":"2022-01-19T20:14:45","guid":{"rendered":"https:\/\/rclalq.qc.ca\/?p=4664"},"modified":"2022-01-19T15:14:59","modified_gmt":"2022-01-19T20:14:59","slug":"publication-des-indices-daugmentation-de-loyer-plus-que-jamais-un-controle-des-loyers-simpose","status":"publish","type":"post","link":"https:\/\/rclalq.qc.ca\/en\/2022\/01\/publication-des-indices-daugmentation-de-loyer-plus-que-jamais-un-controle-des-loyers-simpose\/","title":{"rendered":"Publication des indices d\u2019augmentation de loyer: Plus que jamais, un contr\u00f4le des loyers s\u2019impose"},"content":{"rendered":"\n<p>Montr\u00e9al, le 19 janvier 2022 \u2013 Suite \u00e0 la <a href=\"https:\/\/www.tal.gouv.qc.ca\/fr\/actualites\/le-calcul-de-l-augmentation-des-loyers-en-2022\">publication des estimations moyennes d\u2019augmentation de loyer<\/a> par le Tribunal administratif du logement (TAL), le Regroupement des comit\u00e9s logement et associations de locataires du Qu\u00e9bec (RCLALQ) invite les locataires \u00e0 examiner attentivement leur hausse de loyer et \u00e0 refuser toute augmentation jug\u00e9e abusive.<\/p>\n\n\n\n<p>Le RCLALQ rappelle que ces taux ne sont pas respect\u00e9s d\u2019embl\u00e9e par les propri\u00e9taires et que toutes les hausses de loyer qui ne sont pas contest\u00e9es par les locataires sont l\u00e9gales m\u00eame si elles sont plus \u00e9lev\u00e9es que ce qui est permis par le Tribunal. \u00c0 cet effet, le Regroupement demande \u00e0 la ministre de l\u2019Habitation, Andr\u00e9e Laforest, de rendre obligatoire l\u2019utilisation de ces taux pour stopper <a href=\"https:\/\/rclalq.qc.ca\/2021\/06\/enquete-sur-le-prix-des-logements-a-louer-les-loyers-explosent\/\">la flamb\u00e9e du co\u00fbt des loyers<\/a> que l\u2019on observe actuellement au Qu\u00e9bec. Contrairement \u00e0 ce qu\u2019avance le gouvernement de la CAQ, il n\u2019existe pas de contr\u00f4le des loyers au Qu\u00e9bec puisque c\u2019est sur les \u00e9paules des locataires que repose le fardeau de calculer l\u2019augmentation de loyer.<\/p>\n\n\n\n<p><strong>Estimations moyennes d\u2019augmentation 2022<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"448\" height=\"303\" src=\"https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf.png\" alt=\"\" class=\"wp-image-4665\" srcset=\"https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf.png 448w, https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf-143x97.png 143w, https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf-440x298.png 440w, https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf-306x207.png 306w, https:\/\/rclalq.qc.ca\/wp-content\/uploads\/2022\/01\/Screenshot-2022-01-19-at-15-10-11-Communique-Indices-Regie-du-logement-19-janvier-2022-pdf-200x135.png 200w\" sizes=\"(min-width:1680px) 100vw, (max-width:768px) 100vw, (max-width:530px) 100vw, 100vw\" \/><\/figure>\n\n\n\n<p><strong>Des hausses de loyers toujours plus importantes<\/strong><\/p>\n\n\n\n<p>En juin dernier, <a href=\"https:\/\/rclalq.qc.ca\/2021\/06\/enquete-sur-le-prix-des-logements-a-louer-les-loyers-explosent\/\">une \u00e9tude du RCLALQ<\/a> d\u00e9voilait que le co\u00fbt des logements \u00e0 louer \u00e9tait de 46% plus \u00e9lev\u00e9 que la moyenne de l\u2019ensemble des logements pour la grande r\u00e9gion de Montr\u00e9al. Ces taux sont particuli\u00e8rement \u00e9lev\u00e9s pour les grands logements (14% \u00e0 Qu\u00e9bec, 23% au Saguenay, 29% \u00e0 Trois-Rivi\u00e8res, 34% \u00e0 Sherbrooke et 54% \u00e0 Montr\u00e9al) qui sont n\u00e9cessaires aux familles.<\/p>\n\n\n\n<p>Avec la sp\u00e9culation immobili\u00e8re qui bat son plein depuis le d\u00e9but de la pand\u00e9mie, plusieurs nouveaux propri\u00e9taires tentent d\u2019imposer d\u2019importantes hausses de loyer \u00e0 leurs locataires pour absorber le co\u00fbt d\u2019un immeuble pay\u00e9 trop cher. D\u2019autres veulent augmenter leurs loyers pour les fixer au \u00ab prix du march\u00e9 \u00bb alors que ce dernier s\u2019emballe. <a href=\"https:\/\/rclalq.qc.ca\/2021\/09\/rapport-annuel-du-tribunal-administratif-du-logement-un-bond-important-des-reprises-de-logement-malgre-une-baisse-du-nombre-de-dossiers-ouverts\/\">Le nombre de reprises de logement et d\u2019\u00e9victions en tout genre se multiplient<\/a> puisqu\u2019en l\u2019absence d\u2019un registre des loyers, les propri\u00e9taires de mauvaise foi utilisent ces tactiques pour hausser abusivement le loyer lors du changement de locataire.<\/p>\n\n\n\n<p>Pour le RCLALQ, obliger les propri\u00e9taires \u00e0 respecter les taux \u00e9mis par le TAL permettrait de contrer le ph\u00e9nom\u00e8ne des hausses abusives, mais \u00e9galement celui des reprises de logement et des \u00e9victions ill\u00e9gales. Le gouvernement du Qu\u00e9bec doit intervenir de toute urgence alors que les m\u00e9nages locataires \u00e0 faible revenu sont grandement touch\u00e9s par la hausse du prix des biens essentiels et non pas la marge de man\u0153uvre n\u00e9cessaire dans leur budget pour absorber une hausse de loyer suppl\u00e9mentaire.<\/p>\n\n\n\n<p><strong>Refuser sa hausse de loyer, c\u2019est un droit&nbsp;!<\/strong><\/p>\n\n\n\n<p>Suite \u00e0 la r\u00e9ception de l\u2019avis d\u2019augmentation de loyer, les locataires ont 30 jours pour r\u00e9pondre \u00e0 leur propri\u00e9taire. \u00c0 cet effet, les locataires peuvent refuser une hausse de loyer tout en demeurant dans leur logement. Pour plus d\u2019informations \u00e0 ce sujet, le RCLALQ invite les locataires \u00e0 <a href=\"https:\/\/rclalq.qc.ca\/comites-logement\/\">communiquer avec le comit\u00e9 logement de leur secteur<\/a>. De plus, le RCLALQ m\u00e8ne actuellement la <a href=\"https:\/\/rclalq.qc.ca\/campagne\/controledesloyers\/\">campagne \u00ab Les loyers explosent&nbsp;: Un contr\u00f4le s\u2019impose \u00bb<\/a>
